the affidavit Appendix III B which needs to be prior to the date of application was not submitted by the petitioner, but it was of a later date and for that reason her candidature could not be accepted under Group-1 category as per the Brochure Guidelines. He would further submit that the petitioner was aware of this mistake, therefore, she submitted a fresh Appendix III B dated 07.01.2019 along with representation dated 24.09.2019, whereas earlier the certificate dated 01.07.2019 was submitted. He would also submit that according to the terms and conditions, the petitioner had to submit the entire document strictly in accordance with Guidelines of Brochure and the respondent authorities have not committed any error of law in rejecting the candidature of the petitioner. In support of his submissions, he placed reliance on the judgment passed by the High Court of Punjab and Haryana at Chandigarh in the matter of Pushpinder Marya and Another Vs. Bharat Petroleum Corporation Ltd. and Another & connected matters, CWP No. 28939 of 2019 , wherein it has been held that ‘Appendix-IIIB of a later date may not per se be illegal so long as the same certifies that the land offered by an applicant fulfilled the criteria laid down in the Brochure as on the date of the application. Yet, various stipulations contained in the application form, leave no manner of doubt that the same must be of the date of application or a date earlier but not of a later date.’
