Heard Mr. Kashif Shakeel, learned counsel for the appellant. Also heard Mr. H.B. Agrawal, learned Senior Counsel assisted by Ms. Swati Agrawal, learned counsel for the respondent No.1 on I.A. No.02/2023, which is an application for condonation of delay of 34 days in filing the appeal.

Learned counsel appearing for the parties submit that the issue involved in this writ appeal has already been decided by this Court in WA No.492 of 2023 vide order dated 11.12.2023 (Shailendra Kumar Thakur v. Chief Executive Officer and others), whereby this Court dismissed the writ appeal by observing as under:-

“14. Considering the submissions advanced submissions advanced by the learned counsel for the parties, perusing the impugned order and the finding recorded by the learned Single Judge while partly allowing the writ petition filed by the respondent No.1/employer by directing them to reinstate the appellant/employee with 25% of back wages, we are of the considered view that the learned Single Judge has not committed any illegality, irregularity or jurisdictional error warranting interference by this Court.

15. Accordingly, the writ appeal being devoid of merit is liable to be and is hereby dismissed. No cost(s).”

In view of the above, the present writ appeal is also dismissed in terms of the order passed by this Court in WA No.492/2023. No costs.
