In the present case, Bhulan (PW-1) (brother of the deceased), who has lodged a complaint (Ex.P/1) to the Police Station Shankargarh and on the basis of that information FIR (Ex.P/9) has been lodged. He has stated in his evidence that the accused and the deceased used to live in candid manner if they did not consume alcohol, but after consuming alcohol the accused always beat his wife. They had advised them several times not to fight amongst themselves. On the date of the incident, it was drizzling and the complainant was in his house, at around 6.00 a.m. in the morning, Rijhani (PW-2) came and told him that, in the courtyard in front of the door of the appellant’s house, Nadhni was lying in an unconscious state and it was raining. So she asked the complainant to go and see what has happened. After that, the complainant went to the house of the accused, he saw that Nadhni Bai was lying dead there, blood was coming out of her ears, her face was black, there was an injury on her forehead, then he told the people of the neighborhood, then people of the neighborhood and the villagers had come and saw the deceased lying dead, Rijhani’s house is in front of the house of the accused. Rijhani told the complainant that the Nadhni Bai was not seen for 1-2 days before the incident. After that, the complainant went to the Police Station and informed about the incident to the Police. Thereafter, the Police went on the spot of the incident and conducted the panchnama proceedings of the dead body. The Police had seized a axe and a wooden stick from the accused in the presence of the the complainant. The Police had interrogated the accused in front of the complainant, in which the accused had told that he had murdered his wife by hitting her with wooden stick.
