1. This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.351/2023 registered at Police Station- Telibandha, District- Raipur (C.G) for the offence punishable under Sections 457, 380, 436, 450, 120(B) of the IPC.
2. At the outset, learned counsel for the applicant submits that the bail application has become infructuous as the applicant has already been acquitted by the Court below. Therefore, he seeks permission of the Court to withdraw the instant bail application.
3. Permission granted.
4. Accordingly, the bail application is dismissed as withdrawn.
