demand of motor-cycle Rajdoot and 5 tola gold and when the father of the complainant/applicant expressed his inability for to give the same, they left the complainant to her parental house, where she resided for about 6 months. Thereafter, a social meeting was convened and after such meeting, she went back to her matrimonial house, but the behaviour of the respondent did not change. Meanwhile, she delivered a girl child and her husband and brother-inlaw ( Nandoi) respondent No.5 Santosh Mishra, on the pretext of her treatment, took her to Burla Hospital and on the same night, she returned to Saraipali. They also take away her daughter and in a deceitful manner left her to the parental house. When she had tried to return back and sat on the motor-cycle of her husband, after travelling to some distance, he pushed her from the running motorcycle and fled away. She further alleged that on 13.12.2002, her husband had solemnized second marriage with another girl namely Banita Das, D/O Pitbas Das, R/O Budamal thana Buden, District- Bargadh. Based on such allegations, the FIR Ex-P/2 was registered. The complainant refused for counseling (Ex-P/3) because of the fact that her husband had already solemnized second marriage. Statement of the witnesses were recorded and the dowry articles vide Ex-P/9, given at the time of the marriage, were seized.
