The facts, in brief, necessary for disposal of the present appeal, are that on 07.10.2006, deceased Jaharlal was going by Bhagwati Mini bus bearing registration No. CG-15ZA-0713 from village Mohli Chowk to village Aprosh. The said bus stopped for sometime in front of Primary School Building of village Chainpur. It is alleged that the driver suddenly drove the bus with jerk, due to which, Jaharlal fell down and came under the rear wheel of bus, as a result of which, his head got crushed under the wheel and he died on the spot. The claimants who are the wife, children and parents of the deceased preferred an application before the Tribunal claiming total compensation of Rs.10,00,000/-. Learned Tribunal, after considering the evidence and documents available on record, awarded total compensation of Rs.7,23,500/- with interest @ 9% per annum, from 24.03.2015 till its realization, in favour of the claimants for their irreparable loss. While passing the impugned award, the Tribunal has fastened the liability of payment of compensation upon the Insurance Company, therefore, the present appeal has been filed for exonerating the insurance company from its liability.
