1. Heard Mr. Abhishek Saraf, learned counsel for the petitioner. Also heard Mr. Malay Jain, learned Panel Lawyer, appearing for the respondent/State.

2. The present petition has been filed by the petitioner with the following prayer:

“ It is, therefore, prayed that the petition may kindly be allowed and the impugned First Information Report/Crime No. 33340017170093, registered at Police Station Gharghoda, District Raigarh (C.G.) against the petitioner may kindly be quashed, in the interest of justice. ”

Learned counsel for the petitioner submits that though the present CRMP has been filed for quashing of the FIR, but in the present case, investigation has been concluded and charge-sheet has been submitted in the Court concerned and he prays that the present petition be dismissed as withdrawn with the liberty to file the same challenging the charge-sheet.

4. Learned State counsel has no objection.

5. Prayer is allowed.

6. In view of the submission made by the learned counsel for the petitioners, the present petition is dismissed as withdrawn with the liberty to the petitioner to file a fresh petition challenging the charge-sheet before the appropriate forum, if so advised.
