Khuman, thereafter, they came to lodge the report. On the report made by the prosecutrix the FIR for the offence under Section 376 was registered Ex.-P/4. The prosecutrix was sent for her medical examination to Primary Health Center Chandkhuri farm, District Raipur for her medical examination where Dr. Kirtishri (PW1) has examined her and gave her report Ex.-P/1. While examining the prosecutrix the doctor has not found any injuries over body of the prosecutrix and opined that no definite opinion regarding rape can be given. Two slides of her vaginal swab were prepared, sealed and handed over. The prosecutrix was referred to Medical College Hospital, Raipur for expert opinion vide Ex.-P/2. She was examined at Medical College Hospital Raipur by Dr. Smt. Preeti Agrawal (PW-6) who after examination gave her report Ex.-P/13, she too has not found any external or internal injury over body of the prosecutrix and she too has said that no definite opinion regarding rape can be given and the patient seems habitual to intercourse. Spot map Ex.-P/5 was prepared by the police. The appellant was arrested on 12-04-2002. His underwear has been seized by the police vide Ex.-P/8. The petticoat and slides prepared from the vaginal swab of the prosecutrix was also seized vide Ex.-P/9 and the seized articles were sent for FSL examination to State Forensic Science Laboratory, Raipur from where report Ex.-P/14 was received in which semen and sperms were found on the petticoat of the prosecutrix, slide prepared from vaginal swab of the prosecutrix and the same were not found on the underwear of the appellant. The police recorded statement of the witnesses under Section 161 of the Cr.P.C. and after completion of the investigation charge sheet was filed against the appellant for offence under Section 376 of the IPC.
