This writ petition has been preferred by the petitioner being aggrieved with order dated 13.04.2023 (Annexure P-8), whereby the prayer made by petitioner for engagement of defence representative has been rejected by the respondent-bank on the ground that Advocate or retired employee of the Bank is not permitted to engage as defence representative.

Learned counsel for the respondent-bank by referring to Rule 44 of the Chhattisgarh Rajya Gramin Bank (Officers & Employees) Service Regulations, 2013 and Circular Annexure R-1 dated 04.12.2013 issued by respondent/Bank, submits that retired employee of the Bank or any Advocate is not permissible for appointment of defence representative, He further places reliance upon the judgment passed by hon’ble Supreme Court in case of (Rajasthan Marudhara Gramin Bank ‘RMGB’) & Anr Versus Ramesh Chandra Meena & Anr reported in 2022 (3) SCC 44. However, he further submits that if the petitioner is ready, they will permit the petitioner to make any employee, who is in the service with the bank to engage him as defence representative.

At this stage, learned counsel for the petitioner submits that he is agreed with the proposal made by learned counsel for the respondent-Bank.

Heard learned counsel for the respective parties.

Considering facts of the case, submissions of learned counsel for the respective parties, writ petition is disposed of at this stage, permitting the petitioner to make his proposal before the respondents for appointment of any employee, who is in service with the Bank as his defence representative, within ‘two weeks’ from today. On submission of such proposal, respondents shall consider and decide the same, within ‘seven days’ from the date of receipt of such proposal.
