This writ petition is preferred by the petitioner seeking following reliefs.

10.1 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ to respondents to immediately issue Pension Payment Order for the petitioner, in the interest of justice.

10.2 That, the respondents may further be directed to grant interest on delayed payment of Pension to the petitioner, in the interest of Justice.

10.3 Any other relief which this Hon’ble Court may deem fit and proper in favour of the petitioner may kindly be passed.

10.4 Cost of the petition may be awarded.

Learned counsel appearing for the petitioner submits that on 31.03.2022 petitioner was retired from the post of ‘Deputy Director’, but till date no order for Pension Payment Order (PPO) has been issued in his favour by the respondents only on the ground that there was a departmental enquiry pending against him. Referring to order dated 25.10.2023 (Annexure D-1) submitted by respondents/State alongwith their reply, she further submits that as of now the said departmental enquiry has been withdrawn by the respondents. Hence, it is prayed that this writ petition may be disposed of directing the concerned respondents to issue the PPO, at the earliest within specified time.

Learned State Counsel does not oppose the limited prayer made by learned Counsel appearing for the petitioner.

Considering facts of the case, submissions made by learned Counsel for the respective parties, documents/material available on record and further considering the subsequent development made in the case, writ petition is disposed of at this stage directing the concerned respondents

-authorities to issue the Pension Payment Order (PPO) positively in favour of the petitioner, in accordance with law and relevant rules, within an outer limit of “45” days’ from the date of receipt of copy of this order.
