Heard on I.A. No. 01, which is an application for withdrawal of writ petition.

Learned counsel for petitioners submits that though the State Government has constructed road on the land of petitioner after taking consent for making payment of amount of compensation. Till date the sale deed is not executed and amount of compensation/ sale consideration is not paid. He however contended that as the conditions mentioned in the award, the validity of the award is only for a period of one year and it is the State Government/ Executive Engineer, Public Works Department to get the sell deed executed and to pay the amount of compensation calculated, through cheque. As even after lapse of amount more than three years, sell deed has not been executed, therefore, award itself is lapsed. He submits that he may be permitted to withdraw these petitions with liberty to file better constituted petition for redressal of their grievance.

In view of aforementioned facts of the case, submission of learned counsel for petitioner I.A. No. 01 is allowed in both the writ petitions and the writ petitions are dismissed as withdrawn with liberty to file better constituted petition.
