Learned counsel for respondent submits that the State Government has taken decision to grant increment to petitioner if they became eligible on the last date of superannuation for the

same and they are not in service on the very next day. The increment is to be fixed on notional basis and, therefore, the respondents have purged the contempt.

Learned counsel for the petitioner does not dispute issuance of the Circular by the State Government in this regard.

In view of the submission made by the counsel for respective parties based on the circular dated 3.8.2023, the contempt proceeding initiated against respondents is dropped. Notice of contempt issued stands discharged.

Accordingly, contempt petition is closed. Petitioner will be at liberty to challenge the said circular if they are aggrieved in any
