1. This is the first bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who has been arrested in connection with Crime No. 0243/2021 registered at Police Station Patan, District Durg (CG) for the offence punishable under Sections 294, 506B, 323, 307, 147, 149, 427, 148, 456 of IPC. The applicant is in jail since 20.12.2021.

2. As per the prosecution case, the applicant along with other accused persons had assaulted the complainant and in the process three persons were injured. The assault was made with the aid of a Lathi and with that of fist.

3. Learned counsel for applicant submits that it is a case where the injuries caused to the injured persons are all simple in nature. No deadly weapon was used in the assault. The applicant has already remained in custody for a period of about six months. It is the further contention of the applicant that taking into consideration the nature of

injury sustained, the offence under Section 307 of IPC is not made out at all. At best it could be a case of 323 or 325 of IPC. Thus, prayed for releasing the applicant on bail.

4. State counsel, on the other hand, opposing the bail application submits that it is a case where the applicant is a habitual offender and he has got a large number of cases registered against him and all of which are of similar nature, therefore, he does not deserve to be released on bail.

5. However, on a query being put to the learned State counsel he fairly concedes that it is a case where the injuries caused to the complainant and the injured persons are all simple in nature.

6. Given the entire facts and circumstances of the case, particularly taking into consideration the period of custody already undergone and the nature of injury sustained, a strong case for grant of bail has been made out.

7. Accordingly, the application for grant of bail is allowed. It is directed that the Applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
