appellant-wife became pregnant and after 4-5 months, a baby boy was born. It was pleaded that in the year 2011, the respondent-husband left the contractual job at Dantewada and came back to his village and joined the services in the Education Department and started residing along with the appellant-wife at Kasdol. The appellant-wife further alleges that at Kasdol also, the respondenthusband misbehaved and subjected her to mental torture. It is stated that out of their wedlock, second child was born in the year 2015, despite that she was being subjected to mental cruelty. The aforesaid fact was informed to the parents of the appellant-wife and the intervention was made by the parents of the appellant-wife and their relatives and they tried to give advice to the respondent-husband, but, misbehaviour was also meted out to them by the respondent-husband and thereafter, the parents of the appellant-wife took back the appellant-wife to Bagbahra and both appellant-wife and respondenthusband were living separately. Subsequently, the appellant-wife was selected on the post of Assistant Professor. It is alleged that thereafter, the respondenthusband was misbehaving continuously and character of the appellant-wife was being assassinated before the neighbours and the family members. It is further alleged that the respondent-husband used to send filthy messages and also used to abuse her, for which, a report was made and alleged that because of the aforesaid reasons, it is difficult for the appellant-wife to live along with the respondent-husband.

that the respondent-husband has subjected the appellant-wife to cruelty and finding was arrived at by the learned Court below, which has not been proved and consequently, the petition claiming decree of divorce filed by the appellantwife was dismissed.

The appellant-wife has referred to the document, which is a report to the police and marked as Ex.P-1, dated 13-04-2018, wherein she has stated that her husband used to doubt the character of her and also used to abuse her, resultantly, the mental cruelty was meted out. No particulars have been shown, but, simply, the allegations have been made by the appellant-wife that her character was being doubted, so, only by reading of Ex.P-1, it cannot be inferred that it would amount to cruelty by the respondent-husband to the appellant-wife.

अतः आज वदनिांक 17.03.2019 को, मै स्विेच्छा से यह वविविाह वविच्छेद पत अपनिी पूणर सहमतत के साथ खलखिा देता हूँ वक आज से मेरा तथा श्रीमती तारा पटेल के बीच पतत और पत्निी का कोई सम्बनध निही रहा। समाज के वनियमो के अनिुसार मै अपनिा जीविनि वबतानिे के खलये और श्रीमती तारा पटेल आपनिा जीविनि वबतानिे के खलए स्वितनत है। हम एक दुसरे के पुनिरवविविाह पर भी कोई आपखत निही कर सकेगे। हमारे बीच वकसी भी पकार के जेविर, धनि आवद का लेनि देनि बावक निही है। मुझे श्रीमती तारा पटेल से इस वविविाह वविच्छेद के बाद कोई जेविर या चलअचल सम्पखत का अतधकार निही रहेगा।
अतः यह लेखि आज वदनिांक 17.03.2019 को स्थानि अनिविरपुर मे समाज के पंचो के समक खलखिा वदया तथा पढ़कर, समझकर, स्विीकारकर, हस्ताकर वकया/अंगुठा लगाया।
अतः यह लेखि विक पर पमाण रहे।

The aforesaid document has been admitted by both the parties, wherein both the parties have decided to live separately to sever their title. It further reads that both parties don’t want to continue their marital life and they are free to live separately and the document is signed by few of the members of the society including the appellant-wife and the respondent-husband.
