| Shri Akhtar Hussain, counsel for the Respondent. The present petition has been filed under Section 378(4) of the Cr.P.C. seeking leave to appeal. After perusal of the impugned judgment dated 05.12.2018 passed by learned Judicial Magistrate First Class, Manendragarh, District Koriya (C.G.) in Complaint Case No.292/2017, I am inclined to allow this petition and the Petitioner is hereby permitted to prefer an appeal against the said judgment. Accordingly, the petition is allowed and disposed of. Registry is directed to register the case as a regular acquittal appeal under the head “Acquittal Appeal” and list the matter thereafter for its admission. Sd/- |
