has already been over and there is no further hurdle for the department to consider the case of the petitioner for promotion and the people identically placed have already been promoted in the cadre and the petitioner also was in the zone of consideration, but because of the punishment, he has not been promoted.
& 3 in this regard who in turn shall consider the case of the petitioner in accordance with the rules and regulations pertaining to the promotion and take a decision on the representation to be made by the petitioner, at the earliest preferably within a period of 90 days from the date of receipt of representation.
