Learned State counsel, upon instructions, informed that the concerned SDO, who is dealing with the case has been transferred and new incumbent has recently taken over charge who is presently on leave.
It is also informed to the Court that the petitioner moved application for transfer of the case and the Commissioner requisitioned the record on 10/09/15 and the records have also been transferred to the Commissioner on 25/09/15 and unless orders are passed on transfer application, present SDO may not decide the case of the petitioner.
The petitioner has not disclosed the facts regarding he himself having moved application for transfer of the case and also did not file subsequent order sheets after 30/04/15.
This petition has been filed in the month of January, 2016. In view of the aforesaid disclosure, I am not inclined to pass any further order in the matter.
Though this Court was inclined to impose cost, looking to the age of the petitioner and that she is a tribal, it is only to be observed that while filing petition, relevant facts are required to be pleaded and cannot be suppressed.
The petition is accordingly dismissed.
Presence of the officer is exempted.
