At the outset, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition with liberty to raise the issue of the non-providing any due opportunity to cross examine the applicants/respondents' witness Raj Kumar Sahu at appropriate stage under the provisions of Section 138 of the Evidence Act.
2 . As prayed, the instant petition is dismissed as withdrawn reserving the aforesaid liberty to the petitioner. No order as to cost.
