After arguing for sometime, learned counsel for the petitioner prays that he be permitted to withdraw the instant petition with liberty to raise the issue of the instant petition regarding hearing of the issues framed by the Court below may be heard as preliminary issues as they are based on the question of law and to raise preposition for appreciation of those issues evidence may not be necessary.
2 . As prayed, the instant petition is dismissed as withdrawn reserving the aforesaid liberty to the petitioner. No order as to cost.
