in the oons‘pectus of the aforesaid facts and circumstances, taking into consideration the prime facie material on record to show that the petitioner was Bhumiswami ofthe iand, admeasuring 5.66 acres in Khasra No.1 88/1of Wiage— Kori and that part of land comprised in that khasra numbers have been found submerged in water under the irrigation project, the State authorities are expected to act fairly in the matter and make necessary enquiry with regardto the claim of the petitioner. Instead of driving the petitioner to tile a suit, it would be proper to direct respondent No.4lSub-Divisional Officer, Kota, to make necessary enquiry with regard to submerging of petitioner's land in the irrigation project.Forthis purpose,SDOshallrequiretheofticer-in—chargeofthesaiddam to submit relevant records before it which existed as on the date of construction of dam. Whatever, revenue records are available with the petitionermaybe submitted by the petitioner before the SEQ. After making enquiry into all these factual aspects, the 3DO shall prepare a report with regard to the alleged fact of inclusion ofr-petitioner's land in the irrigation proiect to the Collector.
