The instant writ petition was filed in the year 2014 praying for a direction upon the respondents to disburse the compensation amount in terms of the award dated 30th May, 2014 with interest thereon. It is found from the averment made in the writ petition that the petitioner’s land was acquired by the competent authority under the National Highways Act, 1956. From the relief itself it appears that after acquisition the respondent authority fixed and settled compensation. Only grievance of the petitioner is that his share should be disbursed as per the award dated 30th May, 2014. After filing of the instant writ petition the petitioner has not taken any step. This Court is absolutely in dark as to whether award has already been disbursed to the petitioner or not.
The learned Advocate for the National Highways is present. It is submitted by the learned Advocate for the National Highways, respondent no. 2 that award in respect of the land was disbursed in the year 2014 and in respect of the structure in the year 2015.
In view of such circumstances, this Court has every reason to hold that the petitioner is not interested to proceed with the instant writ petition. Accordingly, the instant writ petition is dismissed for default.
