. Present petition has been filed for following reliefs :-

“B) By issuing writ of mandamus or any other writ or direction in the like nature, thereby kindly order or direction in like nature, to direct respondent to re-fix the pay-scale of petitioner thereby including additional increments granted by respondent in view of certificate of excellent work.

C) By issuing writ of mandamus or any other appropriate writ, order or direction in like nature, the respondents may be directed to pay/release monetary benefits of additional increments for “Excellent Work” granted to petitioners with consequential benefits to the petitioners by fixing reformative sixth pay scales and for

that purpose issue necessary direction or order to the respondents and to refund the amount recovered from the petitioners, if any.”

Learned AGP, after waiving notice for all the respondents and makes a statement that the petitioners are the government servants and, therefore, they should approach the Maharashtra Administrative Tribunal when they are praying for re-fixation of the pay scale.

Learned Advocate Mr. Saurabh Nikat holding for learned Advocate Mr. Rahul R. Karpe appearing for the petitioners, upon instructions, seeks withdrawal of the writ petition with liberty to approach Maharashtra Administrative Tribunal.

It is not in dispute that the petitioners were the government servants and now they want re-fixation of their pay scales on the basis of certain Government Resolutions as well as the decisions of this Court as well as Apex Court. In view of the same, the writ petition stands disposed of as withdrawn with liberty as prayed.
