By an order dated 5^th January 2026, the matter was stood over to 19^th January 2026 since the Petitioner had not served the Respondents with the copy of the Petition despite the same being filed, as far back as on 24^th October 2024.

On 19^th January 2026, when the matter was called out and as more particularly recorded in the order passed on that date, the Petitioner tendered an Affidavit-of-Service which revealed that service was not yet effected on all the Respondents. As a result, the Petitioner was given yet

another chance and some more time to serve all the Respondents and the matter was stood over to 24^th February 2026.

The Petitioner’s Advocate thereafter filed a praecipe dated 21 January 2026, pursuant to which this Court granted urgent circulation of the present Writ Petition on the ground that on 20^th January 2026, he had only recently received a notice from the Sub-Registrar of Assurances dated 20^th January 2026 that the conveyance would be registered within two days unless his client obtains necessary orders from this Court. Citing this urgency, the matter was placed today on the Supplementary Board.

After hearing the parties at some length, it is revealed that prior to the notice dated 20^th January 2026, the Petitioner was in fact served with an earlier notice from the Sub-Registrar of Assurances dated 2^nd January 2026 giving him time till 16^th January 2026 to obtain orders from this Court, failing which, the Petitioner was put to notice that the conveyance that was submitted to the Sub-Registrar of Assurances would be registered.

It is surprising to note that such prior notice dated 2^nd January 2026 was neither brought to the notice of this Court nor disclosed by the learned Counsel for the Petitioner on the two prior occasions or even today, in his arguments until the same was pointed out by the Defendants. Instead, an impression was attempted to be portrayed that the Sub-Registrar of

Assurances had only afforded two days to the Petitioner to obtain necessary orders from this Court in the present Writ Petition failing which the conveyance would be registered and on this ground of urgency, circulation was obtained.

In these circumstances, this Court is not inclined to entertain the oral application of the Petitioner seeking urgent ad-interim reliefs pursuant to the said letter dated 20^th January 2026.

Accordingly, the matter shall be listed on the scheduled date of hearing, viz. 24^th February 2026.

The Respondents shall file and serve their reply to the present Writ Petition on or before 5^th February 2026.
