students, pursuing their degree in Bachelor of Engineering from the respective colleges affiliated to Respondent No. 2 – Pune University have sought for permission to fill the examination form through their respective colleges for appearing for semesters 5th and 6th of 3rd year and semesters 7th and 8th of 4th year examinations by extending the date of filling the form of examination.

The Applicants have after securing provisional admission to 3rd and 4th year of Bachelor of Engineering have attended lectures, practicals, all other academic activities, which are required for completion of the academic year as per the circulars. The backlog with regard to the 1st and 2nd year have been cleared by them in the month of October / November 2025 by clearing all examinations and this is borne out from the Chart at Exh.B to the Petition.

The Applicants have stated that after appearing for the examinations, this Court had passed an order dated 11th November 2025, wherein in paragraph 12, this Court had directed not to implement “carry on” system for that academic year, save and except, if the benefit has already been extended to some students, the same shall be subject to the outcome of the result of the Petition.

The Applicants by clearing the 1st and 2nd year backlogs as per the results released in the month of January and February 2026, have taken the benefit of the scheme.

The Applicants have accordingly moved the present Interim Application for filling up the examination forms for the 5th and 6th semester examinations for the 3rd year and 7th and 8th semester examinations for the 4th year and which examination forms were to be filled up by 20th April 2026 by extending the date.

This Bench by order dated 6th April 2026 in a similar Interim Application (St.) No. 7872 of 2026 in Writ Petition No. 17486 of 2025, where the Applicants were required to fill up the examination forms for the 10th and final semester examinations by the date of the said order had considered the order dated 25th November 2025 passed by this Court (Kolhapur Bench). A similar adinterim application had been made in view of the examinations being held up due to pendency of the Writ Petition in which “carry on” issue is being determined. The Court had allowed the Petitioners to appear for the rest of the examinations scheduled on 26th November 2025. This Bench had similarly directed the Respondent – University

to make necessary arrangement permitting the Petitioners to appear for the examinations.

Having considered the averments in the present Interim Application and noting that the Applicants have cleared the 1st and 2nd year backlogs and for which results have been declared in January and February 2026 as borne out from the Chart at Exh.B of the Interim Application. Further, taking into consideration that the issue of “carry on” is being determined by this Court and for which the Applicants have taken benefit of, they are eligible to appear for the 5th and 6th semester for 3rd year and 7th and 8th semester for 4th year examinations. Accordingly, we allow prayer clause (c) of the Interim Application by permitting the Petitioners to fill up the examination forms and to appear in the said examinations.

This shall be subject to the outcome of the Petition as well as the determination of the issue of “carry on”. The Applicants shall not claim any equities.
