The original accused no.4 has prayed for anticipatory bail in connection with FIR No.1069/2025 registered with Police Station, Ramtek, District-Nagpur for the offences punishable under Sections 318(4), 336(3), 340(2), 341(2) and 341(1) of the BNS, 2023.

It is the contention of the applicant that only role assigned to the present applicant is that he was present with the main accused and ran way from the spot.

The learned APP has contended that the present applicant was in continuous contact with the main accused and it is due to illegal act he ran away from the spot

According to the learned counsel for the applicant, this court on 25.2.2026 has granted ad-interim anticipatory bail to the applicant with a direction to attend the Police Station which he has attended. This fact is not disputed by the learned APP.

In short, the case of the informant-Pawan Janardhan Kathole is that the original accused no.1 Gajanan Kanade, under pretext of providing him job with a forest department had

accepted amount of Rs.1,50,000/- initially and has also forwarded fake appointment order of the forest department on his mobile. It was also alleged that the another victim of crime had also paid an amount of Rs.2,30,000/- to the accused Gajanan on 28.12.2025. So far as the present applicant is concerned, it was alleged that when the applicant along with his friend Nitin Rathod who was working on the post of forest guard went to meet the original accused no.1, the present applicant was also present there.

The friend of informant Nitin Rathod accompanied the informant as he realised that the appointment order forwarded to the whatsapp of the informant was the fake one. It is further mentioned in the FIR that when accused no.1 asked the informant and another victim of crime Sau. Usha Maske about the remaining amount, it was told by the informant that it was kept in a car with his maternal uncle. Another victim by name Usha told that the amount which kept with the father in law.

The accused no.1 along with the informant and the other victim Usha Maske and the accused no.2 and present applicant sat in a car and proceeded towards the Tahsil Office Ramtek for receiving the joining letter. At that time, the employee attached to the forest department caught hold of the accused no.2 and accused no.3 but the applicant ran away.

It is thus clear that so far as present applicant is concerned, it is alleged that he ran away and was accompanying the accused no.1. It is not the case of the informant that the applicant has either accepted the amount or forwarded any fake documents/appointment order.

The applicant has already attended the Police Station as directed by this court. In that view of the matter, I am inclined to allow the present application.

O R D E R

(i) In the event of arrest, in connection with Crime No.1069/2025 registered with Ramtek Police Station, DistrictNagpur for the offences punishable under Sections 318(4), 336(3), 340(2), 341(2) and 341(1) of the BNS, 2023, the applicant be released on bail on furnishing a P.R. Bond of Rs.25,000/- (Rupees-Twenty Five Thousand only) with one solvent surety in the like amount.

(ii) The applicant shall attend the concerned Police Station as and when required by the Investigating Officer.

(iii) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses.

(iv) The applicant shall not leave India without prior permission of this court.

(v) Application stands disposed of.
