This is an application for anticipatory bail.

The applicant is apprehending his arrest in Crime No. 633 of 2025 registered at Waliv Police Station, Mira – Bhayander, Vasai - Virar for the offences punishable under Sections 115(2), 117(2), 118(1), 352, 351(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

There was a financial dispute between the brother of the applicant and the first informant. It is alleged that on account of said dispute, on the date of incident which took place on 4^th November 2025 the present applicant and other co-accused assaulted the first informant by stump. It is alleged that in the said assault, the first informant sustained grievous injuries.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State.

Learned counsel for the applicant submits that false allegations are made due to financial dispute. It is submitted that there are no other criminal antecedents against the present applicant. Learned counsel for the applicant submits that the prosecution has already filed the charge-sheet against the coaccused.

On the other hand, learned APP for the respondent/State submits that the present applicant assaulted the first informant by stump. It is submitted that considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the first information report. Prima facie, the incident does not appear to be premeditated. There are no other criminal antecedents against the applicant. Considering the said facts, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed.

O R D E R

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No. 633 of 2025 registered at Waliv Police Station, Mira – Bhayander, Vasai -Virar for the offences punishable under Sections 115(2), 117(2), 118(1), 352, 351(2), 351(3) and 3(5) of the
