Heard both the sides.

Applicants are praying for condonation of delay of more than 600 days in preferring first appeals challenging the judgment and award passed by the Reference Court.

Learned counsel Mr. Survase for the applicants has pressed into service the reasons/grounds stated in paragraph Nos.4 to 6 to condone the delay. It is submitted that the delay is not deliberate or attempted to incur undue benefits.

Learned counsel for the claimants would oppose the submissions of the applicants. It is submitted that applicants have not deposited the amount which was condition precedent for granting ad-interim relief.

I have gone through the contents of applications. There

is no reason to doubt bonafides of the applicants. It is desirable to condone the delay and deal with the appeals on their own merits, by adopting practical approach.

For the reasons stated above, civil applications for delay are allowed in terms of prayer clause “B”.
