This is an application for Anticipatory Bail.

The applicant is apprehending his arrest in Crime No. 155 of 2024 registered at Murbad Police Station, Dist-Thane, for the offences punishable under Sections 103, 55, 324(4), 61(2) of the Bhartiya Nyaya Sanhita and under Sections 3, 7, 25 & 27(2) of the Arms Act.

According to the prosecution, on the date of incident,

which took place on 01.07.2024, a gun shot was fired on the window of the first informant’s car which was parked near his

apartment. Accordingly the present crime was registered. During the course of investigation, it was found that there was professional rivalry between the first informant and the present applicant and therefore he hired the other co-accused to kill the first informant.

I have heard the learned counsel for the applicant, learned APP for the respondent-State and the learned counsel for the respondent-first informant.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the applicant is willing to co-operate in the investigation. The learned counsel for the applicant submits that there is a delay of three days in lodging the first information report.

On the other hand, the learned APP for the respondentState submits that there is enough material to connect the applicant with the alleged crime. It is submitted that considering the nature of crime the applicant may not be released on anticipatory bail. The learned counsel for the respondent-first informant submits that earlier attempts were also made to kill the Pramod S.Lakare

first informant.

According to the first informant, multiple attempts were made previously to kill him. However, still there is a delay in lodging the first information report. There is no convincing material in respect of motive attributed to the applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 155 of 2024 registered at Murbad Police Station, Dist-Thane, for the offences punishable under Sections 103, 55, 324(4), 61(2) of the Bhartiya Nyaya Sanhita and under Sections 3, 7, 25 & 27(2) of the Arms Act, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
