length. With their consent, Petition is taken up for
hearing finally at admission stage.
2.A father of a minor daughter in this Petition
challenges order passed by Family Court for meeting
expenses her education.
3.Petitioner is father of a minor daughter. On
behalf of minor daughter, an application was moved
before the learned Family court vide Exh. 30
specifically contending that the daughter is studying
in a particular school and there are expenses to be met
for her schooling of Rs. 38,400/-.

4.Petitioner/Husband filed reply to the said
application wherein no dispute is made by him with
regard to the daughter studying in said school.
Similarly, he never specifically takes exception to the
genuineness of the receipts sought to be produced by
the wife in respect of the said schooling expenses.

6. Perusal of the said reply more than
sufficiently demonstrates that there is no challenge to
the expenses incurred for the purpose of schooling of
the minor daughter. Though it is now sought to be
argued on behalf of the learned Counsel for the

Petitioner that receipts are doubtful, however, in
absence of any pleadings or any such case being made
out before Family Court, this Court is not inclined to
accept the said contentions.
7.Since the Respondent/Wife is able to prove
that expenses of the schooling of her daughter are
required to be met and that she has no source of
income, the order passed by the learned Family Court
cannot be faulted with. It is pertinent to note that in
the impugned order a direction is given to the
Petitioner to pay fees of the daughter directly to the
school which indicates that the Respondent i.e., wife
of the Petitioner would not get anything therefrom the
said amount for herself. Since the Court has directed
father to take responsibility of education/school
expenses of his minor daughter and for want of any
perversity in the said order, this Court is not
inclined to cause any interference therein in exercise
of writ jurisdiction.
8.In the result, Petition stands dismissed.
