The petitioners came to be admitted at the Bachelor of Occupational Therapy Course in the academic year 2020-21. Since the admission was sought in the Economically Weaker Section category, the certificates at the relevant time issued by the Central Government were relied upon. The requirement was of filing a certificate issued by the State Government. When the verification of the certificates was undertaken, the Director of Medical Education and Research submitted its report stating that as a one time measure, these certificates could be allowed on the ground that there was no provision to issue such certificate in academic year 2020-21.

Ignoring these recommendations, the admission of the petitioners have not been regularized for failure to submit such certificates. Both the petitioners have obtained Economically Weaker Section Certificates issued by the Competent Authority under the State Government on 23^rd July 2021 and 4^th March 2022 respectively.

Issue notice to the respondents, returnable on 11^th November 2024. The learned Assistant Government Pleader waives notice for respondent nos.1 and 3. Other respondents be duly served.

In the meanwhile, there shall be ad-interim relief in terms of prayer clause [d] of both the Petitions.
