What is this about?
National Highways Act 1956 acquisition procedure; Section 3-A notification 26.09.2022; Section 3-C objections; Section 3-D(2) declaration and vesting (23.08.2023, 10.01.2024); Section 11(4) RFCTLARR Act 2013 held inapplicable to National Highways Act acquisitions even by analogy; post-notification sale-deeds; collusion with revenue officials; bogus record of wells and trees for higher compensation; Project Director letter 06.04.2023; maintainability and bona fides of PIL; politically motivated litigant; Bombay High Court Public Interest Litigation Rules 2010; frivolous and mischievous petition; exemplary costs Rs. 25,000/-; Ahmednagar-Solapur-Akkalkot greenfield highway km 306.600–344.400; Aurangabad Bench.
What did the court decide?
The provisions of Section 11(4) of the RFCTLARR Act, 2013 cannot be made applicable, even by analogy, to acquisitions under the National Highways Act, 1956: the 1956 Act is a complete code with its own acquisition procedure, compensation computation and challenge remedy; the RFCTLARR Act, 2013 contains no provision applying it to National Highways Act proceedings; and, unlike the amended MRTP Act, no corresponding amendment has been carried to the National Highways Act.
