for bringing the legal heirs of deceased Respondent No.2 – Smt.
Damayati Laxman Pimple alias Hemlata Harichandra Sankhe on
record. Names and details of the legal heirs of Respondent No.3 are
stated in the cause title of the Interim Application. Respondent No.3
expired on 16.12.2022. Application is filed on 02.03.2023. It is the
contention of the Applicants that certified copy of the Death Certificate
was initially refused by the Gram Panchayat when it was asked for and
it is subsequently made available to the Applicant / Petitioner only on

08.03.2023 when it was pointed out that the Death Certificate is
required for filing the present Application. Hence, it is stated that the
Application be considered as filed within limitation and there is no
delay in filing the Application.

4. I have perused the Interim Application.

5. For the reasons stated in the Interim Application, Interim Application stands allowed in terms of prayer clause (A). Delay, if any, in filing the Application stands condoned.

6. Applicants are permitted to carry out the amendment within a period of three weeks from today. Re-verification stands dispensed with. Copy of the amended cause title shall be served on all the parties by the Applicants.
