Heard the learned Advocate for the petitioner at
length.
The learned Advocate for the petitioner fairly stated
that there is no privity of contract between the petitioner and
the respondent No.2. It is submitted that the privity of contract
is between the petitioner and respondent No.1.
When the Court expressed its opinion on the merits
of the matter, learned Advocate for the petitioner made a
request for withdrawal of the petition. The petition, therefore,
stands disposed of and dismissed being withdrawn.
It is made clear that in view of his prayer for
withdrawal, this Court has not gone into the merits of the
matter.
