1. The Petitioner has filed the above Petition seeking the

following reliefs:-

“(a) That this Hon’ble Court be pleased to issue a Writ of Mandamus or any other appropriate writ, order or direction in the nature of Writ thereby directing the Respondent Nos. 1 and 2 to

i. Accept from the Petitioners, the amount as claimed by the Respondent No. 2 vide its letter dated 25.02.2020 and finalize the issue of eligibility of the slum dwellers as mentioned in such letter dated 25.02.2020.

ii to decide the eligibility of the

remaining slum dwellers (total 39 in numbers, as per the list annexed herewith at Exh-H) who have been heard during the hearings conducted pursuant to the notices dated 10.06.2021 issued by the Respondent No. 2 and finalize the Annexure II as regards the slum dwellers situated on the plot of land being CTS no. 735, 745(part), 747(part), 748 (part) of village Kandivali, Taluka Borivli, Mumb ai- 400067 within some specific time frame as may be directed by this Hon’ble Court.

(b) Pending the hearing and final disposal of the present Petition this Hon’ble Court be pleased to direct the Respondent Nos.1 and 2 to expeditiously complete the process of deciding the Annexure II as regards the slum dwellers situated on the plot of land being CTS no. 735, 745(part), 747(part), 748 (part) of village Kandivali, Taluka Borivli, Mumb ai- 400067.”

2. Learned Counsel for the Respondent-Corporation on

instructions from Mr. Nitesh Chandrakant Padave, Rent Collector, R/South Ward, states that the process of finalisation of eligibility of slum dwellers is in progress and it will take about 4 months.

We are told that the rehab building is already constructed and the slum dwellers are waiting to be accommodated in the new rehab building.

In these circumstances, though the period of 4 months is sought, we direct the Respondent-Corporation to complete the process of finalisation of eligibility of slum dwellers within 10 weeks from today.

We clarify that if the amount as claimed by Respondent No. 2 vide its letter dated 25^th February, 2020, is paid by the Petitioners within three weeks from today, the same shall be accepted by the Respondent-Corporation and issue of their eligibility shall also be decided.

The Writ Petition is disposed of in the aforesaid terms.
