Mr.Kshirsagar, learned Counsel for the petitioner states that during
the pendency of this petition, respondent no.4-bank stands
amalgamated with the Indian Overseas Bank.
2.He would fairly state that in view of such development, this
petition can be disposed of, however with liberty to the petitioner to
prosecute this petition in the event it is felt necessary for the petitioner
to pursue the cause of action being asserted in this petition.
3.The suggestion of Mr.Kshirsagar is fair. The petition is accordingly
disposed of subject to the liberty to the petitioner to revive the petition
in case the cause of action to the petitioner revives in the changed
situation. All contentions in that regard are expressly kept open.
3.Disposed of in the above in terms. No costs.
