The Applicant is seeking anticipatory bail in connection with C.R.No.I–75 of 2021 registered with Tokawade Police Station, Thane Rural, on 28^th April, 2021, under Sections 406 and 420 r/w. 34 of the Indian Penal Code (for short ‘IPC’).

2 The First Information Report (for short ‘FIR’) is lodged on 28^th April, 2021. The case of the prosecution is that, the Government had foated a social welfare scheme to give economical support to Mahila Bachat Gat i.e. Small Saving Groups. One Anita Mahila Bachat Gat had applied for fnancial

assistance and an amount of Rs.1,90,500/- was sanctioned and disbursed for the beneft of members of the said Bachat Gat. The said Bachat Gat was registered in the year 2006. Subsequently, all the members had changed. The allegations are that, some unqualifed bogus persons had sought fnancial assistance through that Bachat Gat. The applicant was working as Livestock Development Supervisor. Allegations against him are that, he had prepared the bill in the name of that Bachat Gat and had submitted it to the Panchayat Samiti. Thereafter the amount was sanctioned and then it was transferred in the account of Anita Mahila Bachat Gat.

3 Learned counsel for the applicant invited my attention to the order dated 28^th July, 2021, passed by this court in A.B.A.No.1490 of 2021. By the said order, Dr.Malti Salve was granted anticipatory bail. She was superior oficer of the present applicant. There are common allegations against the present applicant, as well as, Dr. Malti Salve who is granted anticipatory bail by this Court. Learned counsel for the applicant further submitted that the dispute was between the present members and past members of the said Bachat Gat and the applicant had no means to know their internal dispute. He had processed the

proposal properly and had disbursed the loan sanctioned by the Government. His role is not diferent from his superior oficer who is granted anticipatory bail by this Court.

4 Applicant was granted interim protection by order dated 6^th August, 2021. Applicant was directed to attend the concerned police station as and when called by the police and cooperate with the investigation. Learned counsel for the applicant submits that the applicant was not called by the police.

5 In the light of the factual aspects as stated above, the interim protection granted by this Court vide order dated 6^th August, 2021, can be confrmed.

(i) Anticipatory Bail Application No.1841 of 2021, is allowed;

(ii) Interim order dated 6^th August, 2021, is confrmed;

(iii) In the event of arrest of applicant in connection with C.R.No.I–75 of 2021 registered with

Tokawade Police Station, Thane Rural, the applicant be released on bail on executing P.R.Bond in the sum of Rs.30,000/-, with one or more sureties in the like amount;

(iv) Applicant shall appear before the investigating oficer as and when called for, till fling of the charge–sheet;

(v) Anticipatory Bail Application No.1841 of 2021, stands disposed of.
