William Rosario Fernandes and 4 Ors., Vs State of Goa, Thr. Its Chief Secretary and 12 Ors.

A. Issue a writ of mandamus or a writ in the nature of mandamus directing the Goa Coastal Zone Management Authority (GCZMA) and the Respondent no. 1 to 5 to take action against the illegal construction carried out by respondent no. 11 to 13 in accordance with law in time bound manner.

B. Issue appropriate writ to the Dy. Director of Panchayat to decide the Panchayat Appeal No. Case no. DDPS/Illegal-const/65/2016 pending before him in time bound.

So far as relief in prayer clause A, it is reported that GCZMA has already made its report and passed demolition order. Accordingly, relief in terms of prayer Clause A stands worked out.

In so far as prayer clause B is concerned, we do not know the status of pendency before the Deputy Director of Panchayat. In any case, we direct the Deputy Director of Panchayat to dispose of the Panchayat Appeal no. DDPS/illegal-const/65/2016 as expeditiously as possible.

This petition is disposed of on the aforesaid terms.

All concerned to act on the basis of an authenticated copy of this order.

It is made clear that the contentions of all the parties on merits are kept open.
