This Criminal Application is moved by the applicant/accused for suspension of sentence and bail. The applicant/accused is convicted under section 171 of the Indian Penal Code by the judgment and order dated 19^th April, 2012 passed by the learned Judicial Magistrate First Class, Karad, Satara in Summary Criminal Case No. 704 of 2011 by which the applicant/accused is sentenced to suffer R.I. for two months with fine of Rs. 200/-, in default to suffer S.I. for two months. challenged by the applicant/accused in Criminal Appeal No. 23 of 2012 and the said Appeal was dismissed on 31^st December, 2018 by the learned Extra Joint Additional Sessions Judge, Karad.

The learned counsel for the applicant/accused submits that the applicant/accused was on bail throughout the trial and Appeal. He further submits that the applicant/accused undertakes that he will attend the hearing of the Revision Application.

4. The learned APP submits to the order of the Court.

In view of the submissions made by the learned counsel and considering the nature of the offence, the application is allowed on the following terms :

(i) The sentence is suspended, pending Revision Application;

(ii) The applicant/accused shall be released on bail upon furnishing P.R.Bond in the sum of Rs. 15,000/- with one or two sureties in the like amount;

(iii) The request of cash bail is accepted. The applicant/accused is permitted to be released on cash bail of Rs. 15,000/- till the applicant/accused furnishes surety in the like amount by 30^th March, 2019.
