Learned Advocate appearing on behalf of the contesting respondent No.1, fairly states that he actually desired to move an application for seeking implementation of the order dated 29.4.2015 passed on the Change Report No.735 of 2003, by the Assistant Charity Commissioner. It was by inadvertence that an application was filed seeking condonation of delay along with a Change Report No. 696 of 2015. He, therefore, submits that the first respondent desires to withdraw the said proceeding / Change Report No.696 of 2015 and move an application for seeking implementation of the order dated 29.4.2016.

have assailed the order dated 29.4.2015 before the Joint Charity Commissioner. Learned counsel for respondent No.1 submits that he is unaware as to whether any order has been passed by the said authority.

Considering the above and in view of the statement made, this petition is disposed off and the proceedings No.696 of 2015 stand disposed off as withdrawn. Consequentially, the impugned order does not survive and stands vacated. Needless to state, the first respondent is at liberty to file the application as stated, subject to pending litigation, if any and in view of the judgment dated 29.6.2016, delivered by this Court in Writ Petition No.3742 of 2016 and connected matters (Vithalrao Pandurangrao Lahane and another Vs. Satish Bhanudasrao Chavan).
