November, 2012 at about 1.30 a.m. the applicant assaulted Bappa Sitaram,

who was sleeping on the footpath, with a stick. Thereafter, the applicant assaulted Bappa Sitaram with stone on his head. Due to assault on the head, the skull was fractured. There was also contusion in the occipital and parietal region, which were 5 X 5 X 1 cm in size. The deceased had also sustained some other injuries. Looking to the evidence on record, we do not think this is a fit case to grant bail.
