. The learned counsel appearing for the City and Industrial Development Corporation of Maharashtra Limited, on instructions, states that the said Corporation will withdraw the communication dated 14^th February, 2014 and shall pass appropriate order on application dated 31^st December, 2013 made by the Petitioners through their Architects within a period of two months from today. We accept the said statement. In view of the said statement, the Petition need not be kept pending and the same is disposed of by passing the following order:-

(i) We direct the Respondent No.1 to decide the application

dated 31^st December, 2013 made by the Architects of the Petitioners within a period of two months from today;

¶18

(ii) The order passed on the said application be communicated either to the Petitioners or their licensed Architects. Till the communication of the order passed on the application either to the Petitioners or to their licensed Architects, whichever is earlier, ad-interim relief granted in terms of clause 4 of the order dated 20^th January, 2014 shall continue to operate;

(iii) In the event, the order be adverse to the Petitioners, adinterim relief shall continue to operate for a period of four weeks from the date of receipt of communication as aforesaid;

(iv) We make it clear that we have made no adjudication on the application made by the Petitioners for toleration of the structures and all contentions of parties are kept open;

(v) Petition is disposed of on above terms.
