2 The learned counsel appearing for the Corporation on instructions makes a statement that the impugned communication at Exhibit-F to the petitioner made by the Dy. Chief Engineer (Rds) W.S. addressed to the petitioner intimating that the offer which is held non-responsive for failure to submit B.G. of requisite amount for unregistered plant before the date of submission on or before 20/09/2014, stands withdrawn. It is further submitted that the Corporation would pass a fresh order on the basis of the available record and intimate the decision to the petitioner.

3 We grant liberty to the Corporation to pass a fresh order, on the statement made by the learned counsel appearing for the Corporation that the impugned communication stands withdrawn.

4 We direct the Corporation that till the decision is taken

by it and communicated to the petitioner, no further steps shall be taken consequent to the issuance of tender.
