Vikram Namdeo Jagtap and Others Vs the State of Maharashtra

. The Petitioners have tendered an application to the Special Land Acquisition Officer on 10th September, 2001 requesting the Special Land Acquisition Officer to refer the matter to the Civil Court for determination of the compensation payable in accordance with the Land Acquisition Act. According to the Petitioners, the Special Land Acquisition Officer has not communicated as to whether the matter is referred to the Civil Court or not or that he has refused to refer the matter to the Civil Court. The Land Acquisition Officer is supposed to inform the Petitioners atleast after they tendered an application requesting him to inform the progress in the matter as to what is the outcome of the application tendered by the Petitioners seeking reference of the matter to the Civil Court.

2 In view of the facts and circumstances of the case, the writ petition is disposed of with a direction to the Special Land Acquisition Officer No.14 Ahmednagar, Ahmednagar to take decision on the application tendered by the Petitioners under Section 18 of the Land Acquisition Act and communicate the said decision to the Petitioners as expeditiously as possible and preferably within a period of three months from today. If the decision has already been taken by the Special Land Acquisition Officer, he shall communicate the same to the Petitioners accordingly.
