Ramkrishna Kushaba Gawade Vs the State of Mah and Ors.

1 This petition can be disposed of by directing the State Government to take decision on the representation tendered by the Municipal Corporation on 04.06.2011 through the Deputy Director of Town Planning, Maharashtra State, Pune. The Municipal Corporation, Ahmednagar, while communicating the difficulties in implementation of town planning scheme nos.5 & 6, opined that the scheme, as proposed, is not capable of implementation. The proposal tendered by the Corporation to the Assistant Director, Town Planning, Maharashtra State, Pune, has been forwarded to the State Government with favourable recommendations by the concerned authority informing the State that appropriate steps need be taken for deletion of town planning scheme no.5 & 6 since the said scheme is not capable of implementation by the Municipal Corporation. The communication is made in pursuance to the Resolution passed by the General Body of the Corporation.

2 In the facts and circumstances, the State Government, through its Urban Development Department, is directed to take decision on the proposal tendered by the Municipal Corporation together with recommendations by the Assistant Director, Town Planning, Maharashtra State, Pune, as expeditiously as possible, preferably within a period of six months from today.

3 With the directions as above, writ petition stands disposed of.
