1 The petitioner, in this petition, is praying for initiation of action against Respondent No.4 based upon certain allegations levelled against office bearers of the Society.

2 An affidavit-in-reply has been presented on behalf of Respondent-State sworn by Respondent No.3 - District Deputy Registrar, Co-operative Societies, wherein it is stated that an inquiry under Section 83 of the Maharashtra Cooperative Societies Act, 1960, is initiated against the Society and report, in that regard, is called for.

3 Today, it is pointed out that the inquiry proceedings under Section 83 of the Act of 1960 are complete and the officer appointed by the Cooperation Department has recommended initiation of proceedings under Section 88 of the Act of 1960 and Respondent-Society is called upon to show cause as to why

proceedings under Section 88 of the Act of 1960 shall not be initiated based upon the report of the officer of Cooperation Department.

4 Since the inquiry under Section 83 is complete, we deem it appropriate to dispose of this petition with a direction to Respondent No.3 to take appropriate decision in the matter of initiating action under Section 88 of the Act of 1960 against office bearers of Respondent No.4-Society and if concerned Respondents decide to hold an inquiry, ensure completion of proceedings, as expeditiously as possible, preferably within a period of eight months from today.

5 With the directions, as aforesaid, writ petition stands disposed of.
