The petitioner was in employment as Lecturer in Chemistry in the college operated by respondent no.2 Education Society. The petitioner was also permitted to hold a charge of the post of Head of the Department of Chemistry. It is the contention of petitioner that by order dated 27/8/1997 he was transferred from Osmanabad to Taluka Jath, Dist.Sangali. He was relieved from Osmanabad on 1/9/1997. By order dated 30/8/1997, earlier order of transfer came to be cancelled. Since petitioner was relieved on 1/9/1997, he requested respondent no.4 to permit him to resume duties in view of the cancellation of order of transfer, however, he was not permitted to join. By order dated 8/9/1997, petitioner was again transferred from Osmanabad to Tauka Jath, Dist.Sangali and was relieved on 15/9/97. The petitioner proceeded to College at Jath, however, he was informed that the order dated 15/9/97 has also been cancelled and he should report to the Osmanabad college. The petitioner again requested respondent no.4 to permit him to join at Osmanabad in view of second transfer order. However, he was not permitted to join duties under one pretext or other and as such petitioner was constrained to approach this Court seeking direction to the concerned respondent to allow him to joint the duty.
