states that when the matter was sent to the Mediator,

the petitioner did not appear. It is stated that the

respondent nos. 1 and 2 had shown their willingness

to pay the retiral dues of the deceased husband of the

petitioner immediately. It is stated that since the petitioner was not present, the mediation failed.

Ms. S.S. Singalkar, the learned counsel for

the petitioner states that the petitioner is not interested in seeking appointment on compassionate ground and the grievance of the petitioner would stand redressed if the respondent nos. 1 and 2 pays the retiral dues of the deceased husband of the petitioner including pension, to the petitioner within a short time.

It is stated on behalf of the respondent nos. 1 and 2 that it would be necessary for the petitioner to sign the pension papers and other necessary documents for ensuring payment of the retiral benefits at the earliest.

The learned counsel for the petitioner states that the petitioner would approach the respondent nos. 1 and 2 within a period of 10 days to sign the necessary documents/papers.

We dispose of the writ petition with a direction to the respondent nos. 1 and 2 to send the pension case and other relevant documents for

payment of retiral dues of the petitioners' husband to the petitioner within a period of 15 days from the date on which the petitioner signs the necessary documents, to the Education Officer. The Education Officer should then process the papers and ensure that the retiral dues of the deceased husband of the petitioner are paid to the petitioner at the earliest and positively within a period of four months from the date of receipt of the papers from the respondent nos. 1 and 2. In the facts of the case there shall be no order as to costs.
