1.After this Notice of Motion has been heard at length, Mr.
Makhija, on instructions from the Petitioner who is personally
present in Court, seeks leave to withdraw the Petition. That is not
an application that can be opposed.
2.Leave granted. Petition dismissed as withdrawn.
Consequently, Testamentary Suit No. 73 of 2013 also stands
dismissed as withdrawn. The caveat filed by the Respondent to the
Petition cannot survive and is discharged. In view there of the
present Notice of Motion does not survive and is disposed of
accordingly.
