Corporation. In paragraph 3 of the affidavit, it is
claimed that the said lane/road forms a part of plot
No.13-E in Sector 11 of Nerul,Navi Mumbai. It is
contended that the City and Industrial Development
Corporation Of Maharashtra Limited (for short
`CIDCO') has kept reserved the said plot for daily
bazar/hawkers' bazar. The contention of the Navi
Mumbai Municipal Corporation is that by a leave and
licence agreement dated 8th May 2001, the said plot
has been granted to the said Corporation for a
period of 10 years from 25th March 1997. The
learned counsel for the Corporation states that on
the basis of the said document, the Municipal
Corporation was allowing the daily bazar/hawkers'
bazar to be held in disputed lane. The affidavit
shows that the period of leave and licence granted
to the Municipal Corporation has admittedly come to
an end on 24th March 2007. The Annexures to the
affidavit-in-reply show that the Municipal
Corporation has applied to the CIDCO for grant of
the same plot for a further period of 60 years. As
of today, it is an admitted position that the CIDCO
has neither renewed the leave and licence agreement
nor has granted a fresh licence or lease to the
Municipal Corporation.
