2. It is, however, clarified that all contentions, including that the plaintiffs are not entitled to recover any amount in damages from

the 1st defendant or any of the other defendants are expressly kept
open to the final hearing of the suit. It shall also be open to the
defendants not only to make their submissions on law but also to
frame the questions in cross-examination such that they are
directed to this issue. If necessary, the defendants may apply for
framing of an additional issue to this effect keeping in view the
provisions of Order XIV Rule 1 of the Code of Civil Procedure,
1908.
